This policy explains how Tooluxe Builders, a brand of Kitengela Terrazzo Enterprises Ltd (“we”), collects and uses your personal data, in line with Kenya’s Data Protection Act, 2019. We are the data controller for the personal data described here.
What we collect
- Order details: your name, phone number, email address, delivery address and the products you order.
- Payment details: M-Pesa transaction codes and amounts. We do not see or store your M-Pesa PIN or bank card details.
- Account details: if you create an account, your login email and a securely encrypted password.
- Messages: what you send us on WhatsApp, by email or by phone, including BOQs and photos.
- Technical data: your IP address and browser details, used for security (for example, blocking repeated failed logins) and to keep the site working.
How we use it
- To process, deliver and support your orders, including order and delivery updates (to perform our contract with you).
- To answer your questions and prepare quotes.
- To keep records required by Kenyan tax and accounting law (legal obligation).
- To protect the site and our customers from fraud and abuse (legitimate interest).
We do not sell your data. We will only send you marketing messages if you have agreed to receive them, and you can stop them at any time.
Who we share it with
Only what is needed, with:
- Delivery partners (Bolt riders and couriers): your name, phone number and delivery address.
- Payment providers (Safaricom M-Pesa and KCB Bank), when you pay us.
- Our hosting provider, which stores the website and email on secure servers in the European Union. These countries provide strong data protection safeguards.
- WhatsApp (Meta), if you choose to contact us on WhatsApp.
- Authorities, where the law requires it.
Cookies
We use essential cookies to keep your cart, process checkout and keep you logged in. These are needed for the shop to work. We do not currently use advertising or tracking cookies.
How long we keep it
Order and payment records are kept for at least 5 years, as required by Kenyan tax law. Account data is kept until you ask us to close your account. Messages are kept as long as needed to help you.
Your rights
Under the Data Protection Act, 2019 you can ask to access your data, correct it, have it deleted (where we are not required to keep it), or object to how we use it. To make a request, email orders@tooluxebuilders.com or WhatsApp +254 114 744 327. We will respond within 7 days. If you are not satisfied, you can complain to the Office of the Data Protection Commissioner (odpc.go.ke).
Security
The site uses encrypted connections (HTTPS), passwords are stored encrypted, and access to customer data is limited to staff who need it.
