These terms apply to every order placed on tooluxebuilders.com. By placing an order you agree to them. Please also read our Delivery & Returns policy and Privacy Policy.
1. Who we are
Tooluxe Builders is a brand of Kitengela Terrazzo Enterprises Ltd, a company registered in Kenya, with a shop in Kitengela, Kajiado County. Contact: +254 114 744 327, orders@tooluxebuilders.com.
2. Products and prices
- Prices are in Kenya Shillings (KSh) and include any applicable taxes. Delivery fees are shown separately at checkout.
- We work hard to show accurate descriptions, specifications and photos. Photos may differ slightly from the item supplied, for example in packaging or accessories, and specifications may change as manufacturers update products.
- If a price on the site is clearly wrong, we will contact you before processing the order. You can then accept the correct price or cancel for a full refund.
3. Your order
- Your order is an offer to buy. It is accepted when we confirm it, or when we dispatch or prepare it for pickup.
- Items marked “Available on order” are sourced after you order and are usually dispatched within 2 to 3 working days. If we cannot supply an item, we will offer an alternative or a full refund.
- We may decline or cancel an order, for example if an item is unavailable or we cannot verify payment. If you have paid, we will refund you in full.
4. Payment
- M-Pesa (KCB Paybill): payment instructions are shown at checkout and in your order email. We process your order once payment is received and confirmed.
- Pay at the shop: available for pickup orders only, by M-Pesa or cash when you collect.
- Bolt rider delivery fees are paid directly to the rider on arrival.
5. Delivery, pickup and risk
- Delivery options, fees and timings are set out in our Delivery & Returns policy.
- Please collect pickup orders within 14 days of our notice that they are ready. After that, contact us to arrange collection.
- The goods become your responsibility once delivered to you, or to the person receiving them at your address, or once you collect them.
6. Returns, refunds and warranty
Faulty or wrong items can be returned within 7 days, and refunds are paid by M-Pesa within 3 working days of approval. After that, the manufacturer’s warranty applies where stated. Full details are in our Delivery & Returns policy. Nothing in these terms limits your rights under the Consumer Protection Act, 2012.
7. Safe use
Power tools, machines and pumps must be used according to the manufacturer’s instructions, with suitable protective equipment, and at the correct voltage. We are not responsible for injury, loss or damage caused by misuse, incorrect installation, or use contrary to the instructions.
8. Our liability
Where the law allows, our total liability for any order is limited to the amount you paid for it. We are not liable for indirect losses, such as lost profits or project delays. This does not limit liability that cannot be excluded under Kenyan law.
9. Changes to these terms
We may update these terms from time to time. The version on this page when you place your order applies to that order.
10. Law and disputes
These terms are governed by the laws of Kenya. If you have a complaint, please contact us first and we will try to resolve it quickly. Disputes that cannot be resolved will be handled by the courts of Kenya.
